Terms and Conditions

 

These general terms and conditions apply to all agreements you enter into with Surfcenter B.V., whether it concerns the delivery of items or the provision of services. By placing an order, you indicate your acceptance of the general terms and conditions of delivery.

1. DELIVERY & DELIVERYCOSTS
Surfcenter B.V. delivers the items* within the Netherlands via PostNL, subject to availability. The delivery time for an item is generally 1 to 2 working days from the date of order. However, certain items such as boards, masts, and booms, known as "oversized freight," may be an exception to this rule. The distribution of such items is not handled by PostNL but by UPS. "Oversized freight" refers to items in your order that have a length exceeding 175 cm. If you receive items that you did not order, you must notify Surfcenter B.V. of this as soon as possible. Any inaccuracies in the information provided by Surfcenter B.V. to you must be immediately reported to Surfcenter. You are also responsible for informing Surfcenter B.V. of any changes or inaccuracies in the information you have provided to them.

Pickup
You can also choose to pick up the ordered items yourself.

Deliverycost contribution
In some cases, there may be delivery costs. When picking up the order, the delivery costs are naturally waived.

 

2. PRICES AND PAYMENT OPTIONS
The prices applicable at the time of ordering an item apply. All prices include the legally determined VAT but exclude any applicable delivery costs. The items are paid for via iDEAL.

 

3. RIGHT TO EXCHANGE AND RETURNS
You can return all items purchased in the Surfcenter online shop without stating a reason within 30 working days after receiving the items*. Please note that, in the case of exchange or return, the delivered items may only be used for inspection purposes, similar to trying on items in a physical store, and must be returned with the original labels and tags. If any depreciation occurs due to the use of the items contrary to the provisions stated above, we reserve the right to claim reasonable compensation from you.
After the 30-day period, you can no longer return your purchase without reason. It is your responsibility to prove that you have timely exercised your right to return. Therefore, we recommend that you ensure you have a receipt or similar document.

The paid amount will be refunded to your bank account within 10 working days upon return or cancellation. Please be aware that Surfcenter does not pay dor the return shipping costs.

Consequences of returns
In case of depreciation of an item, Surfcenter B.V. may demand compensation from you. This does not apply if the depreciation of an item is solely attributable to the fitting and inspection of the item, as would have been possible in a physical store as well.

 

4. REFUSAL OF ORDER
Surfcenter B.V. reserves the right to not accept online orders. This decision lies entirely with Surfcenter B.V., and they are not obliged to provide a justification. If Surfcenter does not accept an online order, Surfcenter B.V. will notify you immediately.

 

5. RIGHT OF WITHDRAWAL You have the right to withdraw from the agreement within a period of 14 days without giving any reason. The withdrawal period expires 14 days after the day you, or a third party designated by you who is not the carrier, physically receive the goods. To exercise the right of withdrawal, you must inform us, Surfcenter B.V. BV, of your decision to withdraw from the agreement through an unambiguous statement. You can use the attached model withdrawal form, but you are not obliged to do so. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Right of withdrawal for services
You have the right to withdraw from the agreement within a period of 14 days without giving any reason. The withdrawal period expires 14 days after the conclusion of the agreement.

The right of withdrawal does not apply to consumer purchases relating to the delivery of:

Service contracts, after the service has been fully performed if the execution started with the consumer's explicit prior consent and the consumer acknowledged that they would lose their right of withdrawal once the contract has been fully performed by the trader; Service contracts for the provision of accommodation, if a specific date or period of performance is provided for in the agreement and not for residential purposes, transport of goods, car rental services, and catering; Agreements relating to leisure activities if a specific date or period of performance is provided for in the agreement.

Consequences of withdrawal If you withdraw from the agreement, we will reimburse all payments received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a different type of delivery than the standard delivery offered by us), without undue delay and in any event no later than 14 days from the day we are informed of your decision to withdraw from the agreement. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from the agreement to us. The deadline is met if you send back the goods before the period of 14 days has expired. The direct cost of returning the goods shall be borne by Surfcenter B.V. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

The right of withdrawal does not apply to consumer purchases relating to:

Products that are made to the consumer's specifications or are clearly personalized; Products that are not suitable for return due to reasons of health or hygiene and whose sealing has been broken after delivery; Products that, by their nature, are inseparably mixed with other items after delivery.

 

6. PROTECTION OF PERSONAL DATA & CREDITORS The data necessary for the processing of your order will be stored and, if necessary for the processing of the order, passed on to companies affiliated with us or companies that perform part of our services.
Surfcenter B.V. reserves the right to conduct an analysis of the data provided by you and, based on the information obtained, offer an alternative method of payment. Decisions and conclusions regarding such matters cannot be corresponded.

Your personal data will be treated strictly confidentially and we will strictly adhere to the legal rules regarding the protection of personal data and privacy. Surfcenter B.V. will not sell your personal information to third parties.

In cases where personal data is provided by us to third parties, they are not authorized to use these data for any other purpose than the performance of their task. The third parties with whom Surfcenter B.V. works are bound by Surfcenter B.V.'s conditions, which guarantee your privacy.

If you have subscribed to the newsletter, Surfcenter B.V. may use your personal data for its own advertising purposes in addition to the cases described above. If you do not wish to receive unsolicited advertising from Surfcenter (by mail or email), you can unsubscribe at any time and object to the further use of your personal data for commercial communications. You can unsubscribe with each newsletter received.

 

7. WARRANTY
Unless expressly agreed otherwise, the Dutch legally established warranty provisions apply.
LIABILITY Surfcenter B.V. accepts no liability towards you for any damage unless its liability insurance covers the damage and the insurer pays out in that particular case. Outside of the aforementioned cases, liability is always limited to a maximum of the purchase price of the respective item(s). In no event shall the compensation referred to in this clause exceed €1,000.
Surfcenter B.V. is never liable for consequential damages.

 

8. FORCE MAJEURE
In a situation of force majeure, the obligations of Surfcenter B.V. are suspended. If the period during which the force majeure occurs exceeds two months, both you and Surfcenter B.V. have the right to terminate the agreement without any obligation to pay damages. Force majeure includes, among other things, strikes, staff illness, transport disruptions, and import/export bans, regardless of whether they occur at Surfcenter B.V. or its suppliers.

 

9. ODR PLATFORM
The European Commission provides the European Online Dispute Resolution platform (ODR platform) to make online shopping safer and fairer for consumers and businesses. The European Commission offers an online dispute resolution platform for consumers, which you can find at http://ec.europa.eu/consumers/odr/. We voluntarily participate in a dispute resolution procedure.

 

10. RESERVATION
Errors may occur on the website. These errors may relate to descriptions, prices, etc. Surfcenter B.V. reserves the right to withdraw from the obligation to deliver when the customer can reasonably be expected to know that it is an error. Surfcenter B.V. will ultimately determine when this situation applies.

 

11. PRIVACY
The data necessary for the processing of your order will be stored and, if necessary for the processing of the order, passed on to companies affiliated with us or companies that perform part of our services.

The third parties with whom Surfcenter works are bound by Surfcenter's conditions, which guarantee your privacy.
